Today, on 12 June 2015, a vacation bench of the Supreme Court, comprising of Justice R.K. Agrawal and Justice Amitava Roy, has completed hearing the All India Pre-Medical Test (AIPMT) paper leak case and has reserved its judgment. The judgment as to whether to cancel the AIPMT exam and conduct a re-examination or to allow the CBSE to declare the result, will be delivered on Monday (15 June 2015). Till then the declaration of result of AIPMT will continue to be stayed.

During the hearing, today, the Haryana police asked the Supreme Court to cancel the AIPMT examination since 44 beneficiaries of the irregularities had been identified already and this number was likely to go up. The police suspect that there are around 700 candidates who have benefitted from the AIPMT paper leak.
Solicitor General Ranjit Kumar, who was appearing for CBSE, opposed cancellation of the AIPMT test, saying that 6.3 lakh students cannot be made to take the exam afresh when only 44 students have been found involved in taking benefits through unfair means.
However, the court observed that the examination is vitiated even if one student is being benefited illegally. The Court also said that taking into consideration the past such incidents, CBSE ought to have been more alert about these things and that these things had been happening for last two-three years. The Court also said that the sanctity of the All India Pre-Medical Test for admission to MBBS seats cannot be sacrificed. The Supreme Court further told the CBSE that it (CBSE) has failed and its process is outdated.
If what the Supreme Court said is an indication of things to come on 15 June, when the Court will pass the final order, then there is a chance that AIPMT examination may perhaps be cancelled and a re-test may perhaps be ordered. However, nothing is sure at the moment and we’ll have to wait till 15 June when the Supreme Court will pronounce its final order on the request of the petitioners to cancel the AIPMT examination in view of alleged large-scale irregularities in conducting the 3 May 2015 examination. Earlier, CBSE had requested the Supreme Court to not to cancel the examination saying that culprits can be thrown out even after their admission. So, the suspense continues.
The Supreme Court was hearing the All India Pre-Medical Test (AIPMT) paper leak case in which 3 writ petitions have been filed vide, W.P.(C) No. 298/2015, 299/2015 and 305/2015, filed by Tanvi Sarwal, Jahnvi Shanker and Adeeba Ahmed respectively. These writ petitions were heard together as Item No. 8 today (12 June 2015).
It is pertinent to mention that on 3 June 2015, the Supreme Court had asked the CBSE not to declare the results of All India Pre-Medical Test (AIPMT) till 10 June 2015. Thus, the declaration of the AIPMT results was stayed till 10 June 2015. Subsequently, on 8 June 2015, this matter was mentioned before the Supreme Court and the Supreme Court had directed to list the matter on 12 June 2015 while further extending the stay granted on the declaration of the AIPMT result from 10 June 2015 to 12 June 2015. It is noteworthy that the AIPMT results were to be declared by CBSE by 5 June 2015. But, the declaration of the results has been put on hold due to the stay granted by the Supreme Court since the Court wanted some tangible information to enable it take the decision whether or not to conduct the re-examination / re-test of AIPMT. For that purpose, the court had granted time to Haryana Police to ascertain the number of beneficiaries who allegedly indulged in cheating.
Previously, as reported earlier, on 18 May 2015, the Supreme Court had issued Notice in the writ petition seeking cancellation of the All India Pre-Medical Test (AIPMT) that was conducted on 3 May 2015 over allegations that its paper was leaked in Haryana. On the next date of hearing on 21 May 2015, the Supreme Court had directed the Haryana Police to identify beneficiaries of the AIPMT paper leak. The Central Board of Secondary Education (CBSC) which conducted the AIPMT Examination was to declare the result which was to be hosted on website http://aipmt.nic.in/aipmt/Welcome.aspx.
