The Supreme Court was told on Thursday (7 January 2016) that 60% quota for the children of group A officers belonging to all India services (such as IAS, IPS and IFS) in the elite Sanskriti school was a “complex issue” and could only be sustained by a statutory provision, not merely by an executive decision.

Bombay HC ask molestation accused to sweep roads for dropping case against them

In a unique and strange punishment, the Bombay High Court on Thursday directed four youth from Thane, who stand accused of molestation and attempt to murder, to sweep public roads every week for six months, in return for quashing police proceedings against them. This type of punishment is surprising since it may not be permissible under law. Moreover, dropping case for the charges of attempt to murder (which is serious case) and molestation is itself a serious issue. It is unfortunate that even a high court can propose to pass such an order.

The four accused — Ankit Jadhav, Suhas Thakur, Milind More and Amit Adhakle — had moved the Bombay High Court seeking quashing of the case of molestation and attempt to murder lodged against them in October 2015.

Police said that during the Dussehra procession in Thane last year, the four in an inebriated state misbehaved with some women and assaulted one person who intervened.

Subsequently, police in Naupada lodged a first information report, charging them with attempt to murder and molestation.

The four accused made the plea on grounds that they had amicably resolved the issue with the complainants.

A division bench comprising Justice R.V. More and Justice V.L. Achiliya said the court will quash the case in return for community service.

The court directed the four to sweep public roads in Thane for eight hours every Sunday for the next six months under the supervision of a police officer. [With inputs from IANS]

Supreme Court allows SMYR Consortium to exit from collecting toll in Delhi

The Supreme Court on Thursday (7 January 2016) permitted SMYR Consortium LLP, which collects toll from vehicles entering the national capital for Delhi’s municipal corporations, to exit from the contract as it contended that imposition of Environment Compensation Charge had adversely impacted the toll collections and its business.

The SMYR Consortium has said that imposition of ECC by the apex court’s October 9, 2015 order and its being doubled by the court order of December 16, 2015, had resulted in nearly 35 percent fall in the vehicles entering the national capital, thereby adversely impacting its toll collections and business interest.

4th NLS Law and Technology Legislative Analysis Competition 2015-16

The Law and Technology Society of National Law School of India University, Bangalore is organizing the 4th edition of the NLS Law and Technology Legislative Analysis Competition 2015-16. This National level competition aims to continue the effort to involve students in research and analysis on pending bills that blur the interface between law and technology.

After three successful editions of this competition, they are hoping and aiming to expand their outreach even further this year.

The two bills selected for consideration in this edition are:

  • The Draft Cigarettes and Other Tobacco Products (Prohibition of Advertisements and Regulation of Trade and Commerce, Production, Supply and Distribution) (Amendment) Bill, 2015
  • The Draft Assisted Reproductive Technology (Regulation) Bill, 2014

The deadline for the submission of the paper is 5:00 PM on March 5, 2016.
