Two years imprisonment to IAS officer and then Chairman of Chennai Port Trust in corruption case

As per a Press Release issued by the Central Bureau of Investigation (CBI) on 01.12.2016, the Special Judge for CBI Cases, Chennai, has convicted Shri K. Suresh, IAS., former Chairman of Chennai Port Trust and sentenced him to undergo two years Rigorous Imprisonment with a fine of Rs.10000/- in a corruption case.

It is reported that the CBI had registered a case on the allegations that Shri K. Suresh while working as Chairman, Chennai Port Trust, in the year 2009 had obtained sponsorship for his son for admission to BE (Civil Engineering) of the value of Rs.12 lakh in Anna University from M/s Vijayashanti Builders with whom he had official dealings, without any consideration. M/s Vijayashanti Builders were running two Weigh bridges in the premises of Chennai Port Trust during that period.

It may be pointed out that such an act of obtaining a valuable thing without sufficient consideration is an offence under Section 11 of the Prevention of Corruption Act, 1988, which is reproduced below:

11. Public servant obtaining valuable thing, without consideration from person concerned in proceeding or business transacted by such public servant.—Whoever, being a public servant, accepts or obtains or agrees to accept or attempts to obtain for himself, or for any other person, any valuable thing without consideration, or for a consideration which he knows to be inadequate, from any person whom he knows to have been, or to be, or to be likely to be concerned in any proceeding or business transacted or about to be transacted by such public servant, or having any connection with the official functions of himself or of any public servant to whom he is subordinate, or from any person whom he knows to be interested in or related to the person so concerned, shall be punishable with imprisonment for a term which shall be not less than six months but which may extend to five years and shall also be liable to fine.”

The CBI had filed a charge sheet against Shri K. Suresh before the Principal Special Judge for CBI cases, Chennai under above Section 11 of PC Act 1988. The Trial Court found the accused guilty and convicted him.

As per the Executive Summary Sheet of IAS officers, maintained by the Government online, Shri K. Suresh is an IAS officer of 1982 batch of Madhya Pradesh cadre. He appears to have on 31 August 2015 from the post of Principal Secretary, Transport Department. He was posted as Chairman of the Chennai Port Trust from 03/09/2004 to 30/06/2009.
