Need a help. one year ago my neighbour attacked on my house for my land related problem. I lodged the FIR and 5 persons were arrested and 3 person took anticipatory bail. They also lodged a fake counter FIR against me and my family. Few days ago police informed us for the counter case and requested us to take anticipatory bail. 3 persons of my family took anticipatory bail. But due to some of my personal reason i did not take anticipatory bail. two days ago police has submitted chargesheet where they mentioned my name as an accused . Now Should i go for bail or i will filed discharge application ?
      kindly suggest

Since the charge sheet has already been filed against you, if you are arrested or taken into custody by the court, you may have to apply for regular bail.

As regards filing of discharge application, if you feel that there is not even a prima facie case against you to frame charges, then you may try filing a discharge application.
