JSS Law College, Mysore is organizing the 14th edition of Surana and Surana National Moot Court & National Judgment writing Competition based on corporate law. The competition is to be held from 12th to 14th February 2016.

NATIONAL MOOT COURT COMPETITION

Eligibility Criteria:

  • Students who are presently studying LL.B. in the three year or the five year programme in the institutions which have been invited for the competition.
  • Students of the Institute of Chartered Accounts of India and The Institute of Company Secretaries of India.

Common Law Admission Test (CLAT) 2016 Online Admission Submission to start on January 1, 2016

This time, the Common Law Admission Test 2016 (CLAT-2016), for admission to the National Law Universities in India, is being conducted by Rajiv Gandhi National University of Law, Punjab. The admission process will start with commencement of online application submission with effect from January 1, 2016. A notification was earlier released by RGNUL, Punjab regarding the examination dates and deadlines of CLAT 2016. This notification was released for the Under Graduate Programme (Five Year Integrated B.A., LL.B.(Hons.) Course) as well as the Post Graduate Programme (One Year LL.M. Course).

Supreme Court verdict on Kerala’s liquor policy on 29 December

The Supreme Court on Monday (28 December) declined to entertain a plea seeking to restrain the Election Commission from announcing elections to Greater Hyderabad municipal Corporation (GHMC) on the grounds of alleged presence of duplicate and fake names in the voters list.

Property can be registered with stamp duty less than Circle Rate, holds Delhi High Court

In an important judgment that can benefit a large number of people, Delhi High Court has held, on 23 December 2015, that property can be registered with stamp duty less than the circle rate. It has held that the stamp duty paid on a transfer document need not always be in accordance with the prescribed circle rates and that if the valuation and stamp duty is below the circle rates, the procedure as prescribed in Section 47-A of the Stamp Act (as applicable to Delhi) is to be followed and the property can be registered with lesser stamp duty also.

Proposed amendment in PC Act for sanction for prosecution – confusion and contradictions

Section 19 of the Prevention of Corruption Act, 1988, requires sanction for prosecution of a public servant for offences under the said Act. As per the existing provisions under Section 19, sanction for prosecution is needed only if the public servant is still in service at the time of filing of the chargesheet; and, no such sanction under this section is needed if the public servant has retired or ceases to be in service at the time of filing of the chargesheet (in fact, at the stage of taking cognizance by court). On the other hand, sanction needed under Section 197 of the Cr.P.C. for prosecution of a public servant (to whomsoever this provision is applicable) is required irrespective of whether the public servant continues to be in service or has retired or has ceased to be in service at the time of filing of the chargesheet. Now, an amendment has been proposed to amend Section 19 of the PC Act to require sanction for prosecution under that section even when a public servant has retired or has ceased to be in service at the time of filing of the chargesheet. However, this amendment would not be applicable to all categories of public servants. This proposed amendment is not in line (at least, in its “intent”) with what has been provided under the recently enacted Lokpal and Lokayuktas Act, 2013. It creates confusion and contradictions.

Bombay High Court issues contempt notice to Arundhati Roy in Saibaba matter

The Nagpur bench of the Bombay High Court on Wednesday (23 December 2015) rejected Delhi University professor G.N. Saibaba’s bail plea, directing him to surrender within two days, and also ordered criminal contempt proceedings against author Arundhati Roy for an article on Saibaba’s arrest published in a magazine in May. Maharashtra Police had arrested Saibaba over his alleged Maoist links in May 2014.

Acquittal of Salman Khan in accident case to be challenged in Supreme Court

The Maharashtra government on Wednesday (23 December) informed the Bombay High Court that it will appeal in the Supreme Court against the acquittal of Bollywood star Salman Khan in the 2002 accident case. [Also see: Bombay High Court acquits Salman Khan in 2002 accident case.]

Court asks CBI to give Delhi government photocopies of files seized

A Delhi court on Wednesday (24 December) directed the CBI to give the Delhi government photocopies of files seized from the office of Rajendra Kumar, principal secretary of Chief Minister Arvind Kejriwal. Special Judge Vinod Kumar of the Patiala House Court directed the investigating agency to provide photocopies of the files duly attested by a responsible officer by December 28.

Rajya Sabha passes Arbitration Amendment and Conciliation Bill

The Rajya Sabha on Wednesday (23 December 2015) passed without discussion the Arbitration and Conciliation (Amendment) Bill to replace an Ordinance on arbitration for speedy settlement of high value business disputes. Rs. 20 crore cash found by CBI in raids on IRS officer in corruption case

The CBI raided seven locations – official and residential – of an IRS officer Sanjay Kumar, accused of corruption, and recovered Rs.20 crore cash, records of investment of another Rs.20 crore and details of other property, an official said on Tuesday.

One of the properties is located in the upmarket Bandra and another in Santacruz with both being in the name of Pravesh Constructions, a company run by the Bhujbal family.

Lok Sabha passes Payment of Bonus Amendment Bill

The Lok Sabha on Tuesday (22 December 2015) passed a bill to amend the act on bonus payments to double, to Rs.7,000 per month, the wage ceiling for calculating bonus for factory workers and of some other establishments.

Finance Minister Arun Jaitley on Tuesday (22 December) introduced in the Lok Sabha the Insolvency and Bankruptcy Bill, 2015, which proposes a single bankruptcy code with deadlines for processing insolvency cases, saying progressive legislation for reform should not be delayed by referring it to various parliamentary committees for scrutiny.

Parliament passes Juvenile Justice (Care and Protection of Children) Bill with stringent provisions

Parliament on Tuesday (22 December) passed the juvenile justice bill, a day after members cutting across party lines agreed that the important legislation should be taken up immediately. However, members of Left parties walked out of the Rajya Sabha before the bill was passed, demanding that it should be sent to a select committee of the house.

The Delhi High Court on Tuesday (22 December) issued notice to Chief Minister Arvind Kejriwal and five other AAP leaders in a defamation suit filed by Finance Minister Arun Jaitley. Joint Registrar K. Venugopal sought replies from Kejriwal, Kumar Vishwas, Raghav Chadha, Ashutosh, Sanjay Singh and Deepak Bajpai by February 5.
