  • Dear Sir,
Thank you for your reply and guidance.
I refused many times to the Hon’ble judge and to my lawyer (which persisted in pressurising me to not contest and settle case by compromise). After all this haggling with Hon’ble judge, my own lawyer and opposite party and her lawyer, my mind stopped working and i panicked that judge will do some adverse order against me and somehow in that state i signed.
Since the order has been done by Family Court, do i need to approach the High Court under article 226 or 227 of constitution ?

in reply to: Private witness #1160

    Dear Sir,

Following is the daily order in which i came across the term “private witness”:

One PW namely Anil is present and examined. Bailable
warrant issued to PW Sunita, LASI Amit received back unserved. Bailable
warrant issued to remaining PWs not received back either served or unserved.
Heard. Now, to come upon 21.01.2017 for prosecution evidence. Let private
    witnesses
be summoned through bailable warrant in the sum of Rs. 5000/- with
one surety in the like amount for the date fixed. Warrants be sent through SP
    concerned.

Please help me understand the meaning of Private Witness in above.

    Thank you.

in reply to: Rights of accused during trial #836

Thank you very much for the informative reply. I will be grateful if you can please answer my following queries:

    1. Has the private lawyer of complainant during proceedings of 498a case got right to be present during witness statement and during witness cross-examination, though the case is being fought by the state on behalf of complainant?
    2. In none of court orders complainant’s private lawyer is shown being present, only APP/PP is shown being present on court records/orders. Is this ok or objectionable as per any rule?
    3. Can accused cross-examine the witness(es)? If yes, which rule which allows it?

    4. Can accused(s) be compelled to answer quereis by magistrate under CrPC 313 ?

    Thank you very much.
    Govind

    Thank you Sir.
