Can Society acquire flat if owner out of India?

If owner is not paying Society charges but his relative had paid regularly (uncle-nephew) who was previously nominee but the flat is vacant and not leased out from last 6 yrs. Now society asked nephew not to pay charges.
Does society have rights to acquire the flat if owner is in out of India
And flat is in Mumbai Thane.

The society has the right to recover the society charges from its members. How the arrears of the society will be recovered from its members depends on the provisions of the law applicable in the state concerned.
