Poa issued by plaintiffs as a donner to his agent as a donee to file the oocj suit in the Mumbai high court can 3rd party who is unauthorized occupant in the same oocj suit can challenged the poa on the grounds that the poa issued to agents sons names.

Poa has rectified by the plaintiffs donner that this poa is given to agent donnee not to his sons as state above.

poa subject matter between donner to donee issue 3rd party who is unauthorized occupants has filed 3 complainted 1) perjury motion 2) criminal contempt petition 3) FIR all is pending.

hon’ble court can take suo moto action to punish the unauthorized occupants for these 3 complaints on the same grounds of poa issue.

It is the person holding power of attorney, authorized by plaintiff to file suit or do other things as permitted, who is recognized as the agent of the plaintiff. If there is a defect in the power of attorney, then that may affect the power of the agent to do things, as authorised, on behalf of the plaintiff or the donor of the power. In view of this, the opposite party may be in a position to point out defects in the power of attorney, if any.
